Gender Male Protestation oath 29 Aug 1723 Kingsbridge, Devon, England - A Simon Pepperell of Slapton made his mark on the oath of 1723 (at Kingsbridge); I think it can only have been this Simon. He was aged only 19 but those age 18 and over were required to sign. At the time of writing I have not yet tried to sort out the Slapton Hyne family tree but a Roger Hyne of Slapton signed just before him who may have been an uncle or cousin.

Simon was the only Pepperell to sign. Why was this? There are a couple of possible reasons. There had been an earlier oath in 1715, those who took that were exempt from the need to take the 1723 oath. Clearly Simon would have been too young in 1715, but as only certain officeholders were required to take that one it is unlikely he is the only Pepperell aged 18 and over in 1723 not to have signed.
There was a lack of clarity about who should sign in 1723. Whilst the wording concerning the oath together with a statement from Whitehall published in the London Gazette showed that the oath should be sworn by all men and women who had not taken the 1715 oath, the penalty only concerned those who had legal rights to property. There, was, therefore no incentive for those without to take the trouble. In addition, in March 1723/4 then a new act was passed which said that women were not expected to swear; those who were expected to were just those with 'Lands, Tenements, or hereditaments, of the clear yearly Value of Ten Pounds, or upwards'. It was probably this clarification that removed the need for any Peppperells to sign.
