John BOW
Set As Default Person -
Name John BOW Relationship
with Teresa Ann GOATHAM Born Abt 1823 St. Budeaux, Devon, England
- From the 1851 census where shown as aged 27. Places of birth was also shown as St. Budeaux in 1871, but as Devonport in 1861 census.
Gender Male Occupation 1841 Milton Combe, Buckland Monachorum, Devon, England
Male Servant to Gardener - John Bow, one other male servant (aged 12) and a 13 year old female servant were living in the house of '40' year old gardner Samuel Syms and his wife, John's (rounded down) age given as 15.
Occupation 1851 Ag lab - Living at Welltown in Tamerton Foliot parish, so presumably working on one of the farms near there.
Occupation From 1861 to 1880 Gardener - Domestic gardener according to his 2nd 'wife' Mary nee Justham's death certificate.
In 1861 he was living on Ford Hill in St. Budeaux Parish. The following 3 census entries all included a gardner - where they working / what sort of gardening were they doing? One was shown as a jobbing gardener, while the previous page shows a market gardener living at Whitleigh. There are Whitleigh entries before and after those for Ford Hill so it must have been close to or in this hamlet. There was a large house, Whitleigh Hall, where more than one person must have employed in the garden, but there were other houses in the area e.g. West Park House, owned by a ship owner and merchant, and a house owned by a fund holder on Ford Hill, which might have employed a gardener (both of these had one live-in servant compared with the 8 at Whitleigh Hall).
In 1871 John was living with his family in Tamerton village. On the few pages before and after in the census hardly any households had a single live in servant, but there are several other gardeners shown, so it is not at all apparent where John was working. Tamerton village is not far from Whitleigh (less than a mile, using a footpath across the fields) so John may still have worked there; another big house within easy walking distance was Loosleigh House.

Although Mary and John went through the formalities of getting married their marriage was in fact void, as the prohibited degrees meant a man may not marry his deceased wife's sister. (The law was changed to permit this in 1907). Up until 1835 such a marriage would have been voidable: if it was challenged while both of the couple were still living it would have been declared void, but if unchallenged once one of them had died it was considered valid. There were potential consequences in terms of inheritance and settlement and parish relief, and so couples in these marriages lived with some uncertainty on what the future consequences might be. An attempt to make these marriages permissible in 1835 resulted in the opposite - the law changed to say they were always void.
The main potential consequence on Mary was likely to be that had she needed parish relief her legal place of settlement would be that of her husband John Jury when he died rather than that of John Bow, unless after John's death she acquired her own. It is not clear where John Jury's place of settlement was, but it seems probable it was a parish in Tavistock Poor Law Union, while Tamerton Foliot or St. Budeaux may be where John Bow had legal settlement; these were both in Plympton St. Mary Poor Law Union. Had John Bow and Mary been unable to look after themselves in old age and both needed to go into the workhouse they could have found themselves in different workhouses miles apart.
Fortunately the need did not arise and they both seem to have died at home in Tamerton Foliot.
