'Mary Bowe', abode: Tamerton, aged 73
Notes - Residence at time of 1st marriage given as 8 Boot(?) Lane. Mary was also shown as "of full age" which if true means she was born by 2nd Dec 1818. Name looks odd in 1861 census - more like Clary - C not like other Cs, but Cl not like other Ms! But census taker deaf? - see Isaac widr in 1861 living in cottage at Rickshill [Rix Hill], Whitchurch with dau Eliza and 4 youngest sons; widow in 1871, living by herself at Ri(p?) [Rix] Hill, Whitchurch, age 52. Remarried in 1873, widowed for a second time in 1880, so in 1881 she was in Tamerton Foliot (Louds? Cottage), a nurse, living with 2 stepsons. Several near-by cottages were occupied by families with the surname Cann and in 1891 Mary was living alone, one of several whose address was described as "Cann Cottage".
Made her mark when registering Nicholas' birth and when she married John Jury.

Although Mary and John went through the formalities of getting married their marriage was in fact void, as the prohibited degrees meant a man may not marry his deceased wife's sister. (The law was changed to permit this in 1907). Up until 1835 such a marriage would have been voidable: if it was challenged while both of the couple were still living it would have been declared void, but if unchallenged once one of them had died it was considered valid. There were potential consequences in terms of inheritance and settlement and parish relief, and so couples in these marriages lived with some uncertainty on what the future consequences might be. An attempt to make these marriages permissible in 1835 resulted in the opposite - the law changed to say they were always void.
The main potential consequence on Mary was likely to be that had she needed parish relief her legal place of settlement would be that of her husband John Jury when he died rather than that of John Bow, unless after John's death she acquired her own. It is not clear where John Jury's place of settlement was, but it seems probable it was a parish in Tavistock Poor Law Union, while Tamerton Foliot or St. Budeaux may be where John Bow had legal settlement; these were both in Plympton St. Mary Poor Law Union. Had John Bow and Mary been unable to look after themselves in old age and both needed to go into the workhouse they could have found themselves in different workhouses miles apart.
Fortunately the need did not arise and they both seem to have died at home in Tamerton Foliot.
